TERMS AND CONDITIONS OF SALE – USED IMPORTED ENGINES

1. Subject of the contract

This contract governs the sale of used engines imported from non-EU countries (including, but not limited to, the United States, Japan, and Australia) by Track Frame Motorsport.

The goods subject to sale are used components, with all technical and legal implications deriving from such condition.

2. Nature of used goods and limitation of warranty

Pursuant to Articles 1490 and following of the Italian Civil Code, it is specified that:

• engines are sold as used goods

• they may show wear, tolerances, and variable conditions

• no warranty equivalent to a new product applies

The warranty is strictly limited to what is expressly stated in this document and accepted by the customer.

3. Contract conclusion and irrevocability of the order

The contract is considered concluded upon order confirmation and payment (full or partial).

The customer acknowledges that:

• the product is sourced upon specific request

• an international import procedure is initiated

Therefore, the order becomes irrevocable once the import process has started.
No cancellation, withdrawal, or modification is permitted.

4. Delivery times and limitations

Delivery times are indicative and generally between:

• 45 and 65 days

The customer expressly accepts that delays may occur due to:

• international shipping carriers

• maritime traffic

• port congestion

• customs clearance procedures

• force majeure events

Such delays shall not constitute contractual breach.

5. Limited warranty (“Startup” and installation)

5.1 Shipped engines

For engines shipped on insured pallets:

• limited 14-day Startup warranty from delivery date

• coverage limited to severe defects preventing engine start

If the customer is unable to install the engine within the above timeframe due to justified technical or organizational reasons, the warranty may be extended at the sole discretion of Track Frame Motorsport, provided that:

• the engine remains uninstalled, unopened, and unmodified

• all seals applied by Track Frame Motorsport are fully intact

• the customer provides periodic updates via live video calls

• during such verification, the customer must clearly show:

  • the condition of the engine

  • the integrity of the seals

  • the absence of any tampering

Failure to comply with these conditions will result in denial or immediate termination of the warranty extension.

5.2 Engines installed at our facility

For engines installed at Track Frame Motorsport:

• limited 6-month warranty

• coverage limited to proper mechanical operation under original specifications

6. Essential conditions for warranty validity

The warranty is valid only if:

• the engine is not opened

• no components are removed or replaced

• no modifications are performed

• all seals remain intact

Any violation results in immediate voiding of the warranty.

7. Seals and authorization

Applied seals constitute proof of integrity.

It is strictly forbidden to:

• remove seals

• tamper with seals

• perform unauthorized interventions

Any intervention must be previously authorized in writing.

8. Installation and usage requirements (turbo engines)

During the warranty period:

• original ECU must be used

• any modification (boost pressure, ignition timing, mapping) is strictly prohibited

For turbo engines:

• first startup must be supervised or approved by Track Frame Motorsport

Any non-compliant use results in immediate warranty void.

9. Responsibility for non-original or modified engine selection

If the customer expressly requests:

• an engine different from the original manufacturer specification

• an upgraded, compatible, or “swap” engine

• an engine with specifications differing from the original vehicle setup

the customer assumes full technical and functional responsibility, including but not limited to:

• mechanical compatibility

• electronic compatibility (ECU, wiring, sensors)

• auxiliary system adaptations

• structural or software modifications

Track Frame Motorsport acts solely as supplier/importer upon request and does not guarantee compatibility unless explicitly agreed in writing.

Any issues arising from incompatibility shall not be considered product defects and do not entitle the customer to warranty or refund.

10. Refund conditions (limitation clause)

Refunds are granted exclusively in the following cases:

1. Verified defective engine

   • confirmed through technical inspection by Track Frame Motorsport

   • engine must be intact, unmodified, with seals present

2. Severe delivery delay

   • attributable to carriers or customs authorities

   • significantly exceeding standard delivery timeframes

In all other cases, no refund shall be granted.

11. Limitation of liability

Track Frame Motorsport shall not be liable for:

• improper installation

• misuse

• unauthorized modifications

• incompatibility due to customer choice

• racing or extreme use not declared

• indirect or consequential damages

12. Personal data processing (GDPR)

In accordance with the Regulation (EU) 2016/679, personal data will be processed in compliance with:

• lawfulness

• fairness

• transparency

• data minimization

Data will be used for:

• order and contract management

• legal and tax obligations

• commercial communications (if authorized)

The customer has the right to:

• access

• rectification

• erasure

• restriction of processing

• objection

The data controller is Track Frame Motorsport.

13. Jurisdiction and applicable law

This contract is governed by Italian law.

Any dispute shall fall under the exclusive jurisdiction of the court where Track Frame Motorsport has its registered office, unless otherwise required by mandatory law.

14. Express acceptance

The customer declares to have read and expressly accepted the clauses relating to:

• irrevocability of the order

• warranty limitations

• limitation of liability

• refund conditions

• responsibility for non-original engine selection

pursuant to Article 1341 Italian Civil Code and Article 1342 Italian Civil Code.
